Terms of Service

These Terms of Service ("Terms") govern your access to and use of HeadsUp Alerts ("HeadsUp", "we", "our", or "us"), a mobile application operated by Creedus Group Limited, a company incorporated in New Zealand.

By accessing or using the HeadsUp app, you agree to be bound by these Terms. If you do not agree, you must not use the app.

1. The HeadsUp Service

HeadsUp allows users to follow sports events, teams, and athletes and receive push notifications ("alerts") about upcoming and live sporting moments.

Alerts and commentary are user-generated and are sent by other users of the platform. HeadsUp does not create, verify, or guarantee the accuracy, timing, or reliability of alerts.

2. No Reliance on Alerts

HeadsUp is provided for informational purposes only.

• Alert timing and accuracy are not guaranteed
• Events may start earlier or later than expected, or not occur at all
• You acknowledge that alerts may be incorrect, delayed, duplicated, or missed

You agree that HeadsUp is not responsible for missed events, losses, or any consequences resulting from reliance on alerts.

3. Eligibility

You must be at least 13 years old to use HeadsUp.

By using the app, you represent that you meet this requirement. We may suspend or terminate accounts that are found to belong to users under 13.

4. Accounts and Access

Some features of HeadsUp require you to create an account.

You are responsible for:

• Maintaining the security of your account
• All activity that occurs under your account

We may suspend or terminate your account if you violate these Terms or misuse the service.

5. User Content

5.1 Ownership

You retain ownership of the content you create on HeadsUp, including channels, alerts, and commentary ("User Content").

5.2 Licence to HeadsUp

By submitting User Content, you grant HeadsUp a non-exclusive, worldwide, royalty-free, perpetual licence to host, store, display, distribute, and use your content solely for the purpose of operating, improving, and promoting the HeadsUp service.

6. Content Standards and Moderation

You agree not to post content that:

• Is unlawful, misleading, abusive, or harmful
• Violates the rights of others
• Disrupts the integrity or reliability of the platform

HeadsUp reserves the right to:

• Remove or restrict any content
• Suspend or terminate accounts
• Take these actions at its discretion, with or without notice

7. Commentary and Alert Types

Certain alert types, including commentary alerts, may be subject to eligibility requirements, usage limits, or restrictions.

HeadsUp may:

• Limit the number or frequency of alerts
• Restrict access to specific alert types
• Modify or discontinue alert features at any time

8. Availability and Changes

We may modify, suspend, or discontinue any part of the HeadsUp service at any time.

We do not guarantee that the app will be available at all times or without interruption.

9. Intellectual Property

All rights in the HeadsUp app, excluding User Content, are owned by or licensed to Creedus Group Limited.

You may not copy, modify, or distribute the app or its content except as permitted by these Terms.

10. Disclaimer of Warranties

HeadsUp is provided "as is" and "as available", without warranties of any kind.

To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law:

• HeadsUp and Creedus Group Limited will not be liable for any indirect, incidental, consequential, or special damages
• We will not be liable for losses resulting from reliance on alerts or user-generated content

Our total liability to you for any claim relating to the service will not exceed the amount you paid to use the app (if any).

12. Governing Law

These Terms are governed by the laws of New Zealand.

Any disputes arising from these Terms or the use of HeadsUp will be subject to the exclusive jurisdiction of the courts of New Zealand.

13. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will update the "Last updated" date and may notify users through the app.
